Terms and Conditions for Kids' Dreams Matter, Inc.
These Terms and Conditions ("Agreement") govern your access and use of the online services and resources provided by Kids' Dreams Matter, Inc. (collectively, the "Platform"). This website is operated by Kids' Dreams Matter, Inc. based at 4907 Surrey Park Cir, Katy, Texas, United States, contact@kidsdreamsmatters.org. The Platform may be accessible via multiple websites or applications owned or operated by us or third parties.
By accessing or using the Platform, you agree to this Agreement. Please read this Agreement carefully. If you do not agree to be bound by any part of this Agreement, you should not access the Platform.
When the terms "we", "us", "our", or similar are used, they refer to Kids' Dreams Matter, Inc. (the "Company").
1. Services Provided
The Platform connects individuals with services, resources, and content aimed at promoting mental health awareness and advocacy, particularly for children and teachers. Services offered on the Platform may include access to mental health resources, educational materials, furnished calming rooms, and other supportive services.
**Important Notice**: This Agreement includes a Binding Arbitration and Class Action Waiver as detailed in Section 7.
2. Service Providers and Their Role
The Platform may connect you with various service providers, such as therapists, speakers, counselors, or other professionals, who offer mental health services ("Service Providers").
**For U.S.-Based Providers**: Every service provider on the Platform must be a licensed professional (e.g., licensed therapist, counselor, social worker) and meet applicable state or jurisdiction requirements. They are independent providers, not employees or agents of Kids' Dreams Matter, Inc.
The Platform facilitates access to these services, but the Service Providers are responsible for their own professional performance.
If you feel that the services provided are not suitable for your needs, you may change to a different provider using the Platform’s tools, but availability may be limited based on licensure and geographic location.
3. Limitations of the Platform
The Platform is not designed to handle medical emergencies or immediate crisis intervention. If you are experiencing a medical emergency or feel that you or someone else may be in danger, you should contact your local emergency services immediately.
The Platform does not provide clinical diagnoses, court-mandated services, or legal certifications, including those for emotional support animals.
4. Privacy and Security
Protecting your personal information is important to us. Our practices related to privacy and security can be found in our Privacy Policy [link]. By using the Platform, you agree to the terms outlined in the Privacy Policy, which is incorporated into this Agreement.
5. Intellectual Property
All materials on the Platform, including content, trademarks, and logos, are owned by Kids' Dreams Matter, Inc. or licensed to us. You are granted a limited, non-transferable license to use the Platform for personal, non-commercial purposes.
6. Third-Party Content
The Platform may contain links or references to third-party services or content. Kids' Dreams Matter, Inc. does not control or endorse these third-party services and is not liable for any damages arising from their use.
7. Arbitration Agreement and Class Action Waiver
By accepting these Terms, you agree that any disputes related to this Agreement or the use of the Platform and any Services will be resolved in Texas through binding arbitration on an individual basis. You also waive any right to participate in class actions or collective claims.
Exceptions include small claims or claims seeking injunctive relief related to intellectual property. Arbitration will be conducted in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules.
8. Limitation of Liability
To the maximum extent permitted by law, Kids' Dreams Matter, Inc. is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform or our Services. Our liability for direct damages will not exceed the total amount paid by you in the 12 months preceding your claim.
9. Changes to This Agreement
We may revise this Agreement from time to time by posting updates on the Platform. Continued use of the Platform after such updates means you accept the new terms.
